1. GENERAL

    • Welcome to the Atelier Minerale website (“the Site"). The Site is governed by these Terms and Conditions ("the Terms"). Please read these Terms carefully. You should understand that by using the Site you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Site.

    • Atelier Minerale reserves the right to make changes to the Site and to these Terms at any time. Atelier Minerale is entitled to amend any information, including but not limited to prices, technical specifications, terms of purchase and product offerings without prior notice.

    • The Site, including all information and content, is property of Atelier Minerale. No material from the Site may be copied, republished, distributed, uploaded, posted or transmitted without prior written permission.

    • These Terms govern all contracts, supplies and other services agreed between the customer and Atelier Minerale.

    • No other terms of changes to the Terms shall be binding unless agreed in writing signed by Atelier Minerale.

    • Dutch law is exclusively applicable to all rights, obligations, offers, orders and agreements to which these Terms apply, as well as to these Terms.

    2. ORDER

    • Atelier Minerale shall confirm the customer’s order by e-mail. A contract is created only when payment is confirmed. In the case that Atelier Minerale is unable to establish the customer’s address, the order cannot be accepted. 

    • Orders that for whatever reason have been technically or otherwise disrupted before the payment instructions have been completed are not final, even if the customer has received an order confirmation. In this case Atelier Minerale will in principle not deliver the order, but will endeavour to contact the customer to complete the payment instructions.

    • Atelier Minerale shall act with the greatest possible care in processing orders for articles.

    3. PRICES

    • All prices are including 21% VAT and in euros. Prices can be adjusted and apply from the moment of publication on the site. Price changes do not apply to orders that have already been made.

    • The price applicable is the price set at the date on which you place your order.

    • Offers do not automatically apply to repeat orders.

    • Atelier Minerale cannot be held to an offer if you could have reasonably understood that it is a typo or typo error.

    • The prices quoted in the webstore are exclusive of postage and administration costs. 

    • Shipping costs and payment fees are recognized before confirming the purchase

    • Please note that local charges (sales tax, customs duty) may occur, depending on region and local customs duties. These charges are at the customers own expense.

    4. Payment

    • To complete the order the Customer may pay either by IDEAL (Netherlands), Credit Card or Paypal.

    • Card information is not stored, and all card information is handled over SSL encryption. Please read the terms & conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made.

    5. Shipping & Delivery

    • Orders shall be delivered to the address given by the customer to Atelier Minerale.

    • Atelier Minerale shall process accepted orders as quickly as possible and aims to ship all orders that are in stock within 1-2 working days after receiving the payment.

    • If a product has a longer delivery time or is (temporarily) not available Atelier Minerale will inform the customer shortly after receiving the order.

    • The delivery time on the Site is approximate only and there is no right to compensation if actual delivery takes longer.

    • Shipping to the Netherlands costs €3,80 and is free on orders of €100,00 or more. Orders will be delivered by mailbox post, including track and trace. Shipping costs outside the Netherlands vary - depending on the destination country - from €6,50 to €20,00. Packages outside the Netherlands will be shipped by DHL parcel post, in most cases including track and trace.

    • Atelier Minerale is not responsible for delays caused by shipping companies such as Post NL and DHL. Exceeding any delivery term will never entitle the customer to compensation.

    6. Right to return

    • The customer is entitled to return any article to Atelier Minerale within 14 days of its delivery date, without the need to give a reason. This right also applies to articles that have been reduced in price.

    • The customer will be refunded the amount already paid to Atelier Minerale for the applicable article after the package has arrived at the Atelier Minerale

    • Both the original shipping costs and the shipping costs to return the article, won’t be refunded, unless it concerns an error in delivery caused by Atelier Minerale (see the chapter ‘wrongful delivery’) Returned articles without track & trace that for whatever reason will not arrive in our warehouse will not be refunded.

    • If a customer wishes to exercise the right to return an article, the article must be returned including everything sent with it (jewellery box, information card etc) and the article should be undamaged and unused. Atelier Minerale can refuse a returned article if it suspects that the article has been worn or exposes damage caused by the customer.

    • Before returning the articles, the customer should send an email to hello@atelierminerale.com to announce the return shipment. This email must include customer’s full name, the order number, and if available, the tracking number.

    6. Wrongful Delivery

    • Even though Atelier Minerale takes great care of the shipping of ordered products, it may occur that the order is incomplete. In this case the customer must inform Atelier Minerale within 7 days after receiving the order. Atelier Minerale will make sure that the shipment will be completed, or the order will be sent again.

    • In case Atelier Minerale delivers products that are not in accordance with the order or the received products are damaged or defective, the customer must inform Atelier Minerale within 7 days after receiving the order and return the package. The customer will be refunded the purchase price including all shipment costs.

    • If Atelier Minerale has not received a written complaint within 7 days after receiving the order, Atelier Minerale assumes that the delivery is error free and the products are in perfect condition.

    7. Warranties

    • Atelier Minerale gives a three-month warranty on the quality of the product from the date mentioned on the invoice, which serves as a warranty card.

    8. Liability

      • For direct or indirect damage caused by an article supplied by us, the liability is limited to an amount equal to the selling price of the relevant article

      • Atelier Minerale is not liable for whatever damage that might occur as a consequence of not delivering in time.

      • Atelier Minerale would like to advise that when we discuss healing properties of crystals and stones, we are communicating our own personal beliefs and the results of our own extensive research. Just because a crystal or stone is alleged to have one or more healing properties, either physical, mental, emotional or spiritual, it does not mean that you will definitely experience or benefit from any such properties. Atelier Minerale can therefore never be held responsible for the (lack of) effects of our jewellery. Any information you receive, whether orally, in written form or electronically relating to crystals and stones purchased from Atelier Minerale, should be received and understood in the above context.

        9. Complaints

      • All queries, comments or complaints related to an order, payment, delivery or service can be sent to the following e-mail address: hello@atelierminerale.com. Atelier Minerale will respond to complaints within 7 working days

      10. Force Majeure

      • Events outside Atelier Minerale’s control, that are not reasonably foreseeable, shall be considered Force Majeure, meaning that Atelier Minerale is released from its obligation to fulfill contractual agreements. Example of such events are government action of omission, new of amended legislation, conflict, embargo, fore or flood, sabotage, accident, war, natural disasters, strikes or lack of delivery from suppliers. The Force Majeure also includes government decisions that affect the market negatively and products, e.g. restrictions, warnings, ban, etc.
